Resumen:
La ley que aprobó el Congreso sobre la devolución de aportes al Fonavi costaría al estado S/ 3,835 billones (S/ 3,835′000,000′000,000), advirtió el ministro de Economía y Finanzas, Waldo Mendoza.
De acuerdo al titular del MEF, esta cifra equivale a 50 veces el producto bruto interno (PBI) actual de China. “Eso es lo que ha aprobado el Congreso, y claramente tiene que ir al Tribunal Constitucional”, apuntó en diálogo con RPP.
Explicó que el Parlamento ha planteado que los aportes de los años 80 y 90 se actualicen al índice de precios al consumidor (IPC), sin tomar en cuenta la hiperinflación que sufrió el país.
“Deberíamos pagar S/ 3,835 billones, equivalente a 50 veces el PBI actual de China”, apuntó Mendoza.
El economista indicó que “el Ejecutivo estuvo trabajando de cerca con la comisión creada, pero la propuesta [del Gobierno] fue desestimada, ignorada y sacaron esta norma que si la cumpliésemos pagaríamos en los siguientes mil años”.
El MEF no solo recomendará elevar una demanda de inconstitucionalidad por esta norma, sino sobre otras tres: la ley de negociación colectiva, la de topes a tasas de interés y la del nuevo retiro de los fondos de las AFP.
Explicó que, incluso con la tasa máxima de 83.4% que fijó el Banco Central de Reserva del Perú (BCR) para los créditos de consumo, quedarían excluidas muchas empresas financieras, y sus clientes tendrían que acudir al mercado informal.
“El problema es con las cajas municipales, rurales, las microfinancieras que, por la naturaleza riesgosa del crédito que otorgan, cobran tasas altas”, apuntó.
“¿Dónde van a ir la gente que antes accedía a ese crédito? Al mercado informal. Es una ley que, curiosamente, va en desmedro de los bancos pequeñitos o más frágiles y en desmedro de las personas menos pudientes”, agregó Mendoza.

Resumen:
La Superintendencia de Banca y Seguros (SBS) señaló que el reglamento del retiro de hasta el 100% de la Compensación por Tiempo de Servicios (CTS) publicado por el Gobierno, no requiere de una normativa adicional.
“La Superintendencia de Banca, Seguro y AFP considera que, si bien dicho Decreto Supremo le otorga facultades para emitir normas complementarias, no se requiere de normatividad adicional para su efectivo cumplimiento”, dijo la entidad en un comunicado.
La disposición complementaria del Decreto Supremo Nº 010-2021-TR dada hoy por el Ministerio de Trabajo y Promoción del Empleo (MTPE) señala que la SBS se encuentra en capacidad de “dictar las normas necesarias en el marco de su competencia”, lo cual no será llevado a cabo según el pronunciamiento del ente supervisor.
“En consecuencia, las entidades del sistema financiero y las cooperativas de ahorro y crédito (Coopac) deben atender las solicitudes de retiro de la CTS, que presenten los trabajadores, de acuerdo con lo establecido en el referido Reglamento y desde la fecha de su entrada en vigencia”, indicó.
Según la CCL, se podrá hacer el retiro total incluyendo los intereses generados a la fecha de la solicitud del retiro, el mismo que podrá realizarse en forma presencial en las oficinas de la entidad depositaria.
Los trabajadores del sector privado cualquiera sea su régimen laboral, esto es, los trabajadores de planilla de las micro, pequeñas, medianas y de la gran empresa.
También los trabajadores de las empresas del Estado sujetos al régimen laboral privado que tiene derecho a percibir la CTS.
Igualmente los trabajadores del sector público sujetos al régimen laboral privado, con derecho a percibir CTS.
La norma aprobada por el Congreso de la República y promulgada por el Poder Ejecutivo señala que el plazo máximo para solicitar el retiro de la CTS es hasta el 31 de diciembre de 2021.
